Terms of Use & Sale
Effective October 19, 2026
These terms apply to your use of evercrestny.com and to quotes and orders from Evercrest Global Inc., doing business as Evercrest ("Evercrest", "we", "us"). A written quote or invoice may add project-specific terms; if it conflicts with these terms, the quote or invoice controls.
1. Website content
This website is for general information. Products, colors, door styles, specifications and availability may change without notice. Nothing on this website is an offer to sell at a stated price. Prices are given only in a written quote.
2. Photos, colors and natural variation
Photos, videos and renderings are for reference only. Color and finish on screen vary with device, lighting and photography. Natural stone, wood, quartz and printed quartz vary from slab to slab, batch to batch and over time, including veining, shade and grain. If color matters to your project, request a sample door or view the slab before ordering. Variation within normal industry standards is not a defect. Some inspiration images show work by partners or spaces at industry showrooms and are not a representation of a specific Evercrest product.
3. Quotes and orders
- Quotes are valid for 30 days unless the quote says otherwise, and are subject to supplier stock and price changes.
- An order is confirmed only when you approve the final quote and layout in writing and we receive the required deposit.
- You are responsible for reviewing and approving the final layout, cabinet list, dimensions, colors and countertop details. Once approved, the order is produced as approved.
- If you or your contractor supply measurements, you are responsible for their accuracy. Field changes or remeasures caused by site conditions or inaccurate measurements are billed separately.
4. Payment
Deposit and payment terms are stated on each quote or invoice. Unless agreed otherwise in writing, the balance is due before delivery. Materials remain the property of Evercrest until paid in full. Returned payments and collection costs are charged to the customer as permitted by law.
5. Cancellations and returns
- Special-order, custom, assembled and modified items, and all fabricated countertops, cannot be cancelled once ordered and cannot be returned.
- Any other return requires our written approval in advance. Approved returns must be unused, undamaged and in original packaging, and may be subject to a restocking fee and return freight.
6. Delivery and inspection
- Lead times and delivery dates are estimates. We are not responsible for delays caused by manufacturers, carriers, weather, site access or other events outside our control.
- You must provide safe, clear access to the delivery location and someone to receive the order. Extra trips, carrying or storage caused by site conditions may be billed.
- Risk of loss passes to you on delivery.
- Inspect every item at delivery. Visible damage or missing items must be noted on the delivery receipt and reported to us in writing, with photos, within 48 hours. Claims for damage or defects must be made before installation; we cannot accept claims for items that have been installed.
7. Fabrication and installation
Where we arrange measuring, countertop fabrication or installation, the work is performed by independent fabricators and contractors. Their workmanship is covered by their own terms. You are responsible for site readiness, including level floors and walls, plumbing, electrical, appliance specifications and any permits. Countertop measurements are taken after cabinets are installed; seams are placed as fabrication requires.
8. Warranty
Products are covered only by the manufacturer's warranty, where one is provided, and we will pass it through to you and help you make a claim. Warranties do not cover misuse, improper installation, moisture or site conditions, normal wear, or natural variation. EXCEPT FOR THE MANUFACTURER'S WARRANTY, PRODUCTS ARE SOLD "AS IS" AND EVERCREST MAKES NO OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, TO THE FULLEST EXTENT PERMITTED BY LAW.
9. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, EVERCREST'S TOTAL LIABILITY FOR ANY CLAIM RELATED TO A PRODUCT OR ORDER IS LIMITED TO REPAIRING OR REPLACING THE AFFECTED PRODUCT OR REFUNDING THE AMOUNT PAID FOR IT, AT OUR CHOICE. EVERCREST IS NOT LIABLE FOR INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES, INCLUDING LABOR, REMOVAL OR REINSTALLATION COSTS, PROJECT DELAYS, LOST RENT OR LOST PROFITS.
10. Brands and intellectual property
The content and design of this website belong to Evercrest. Product and brand names of other companies are trademarks of their owners and are used only to identify products; their use does not mean those companies endorse or are affiliated with Evercrest. Links to other websites are provided for convenience. If you believe content on this website belongs to you and should be credited or removed, email team@evercrestny.com and we will review it promptly.
11. Governing law
These terms are governed by the laws of the State of New York. Any dispute will be brought in the state or federal courts located in Nassau County, New York, unless otherwise required by law.
12. Changes
We may update these terms. The version in effect when your order is confirmed applies to that order.
